By accessing or using One Shotr ("Service"), operated by One Shotr ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use this Service. By using our Service, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" and "your" will refer to that organization.

One Shotr is an AI-powered prompt engineering and optimization platform. Our Service allows users to:

• Input rough ideas, concepts, or draft prompts and receive optimized, professionally engineered AI prompts
• Generate prompts optimized for specific AI platforms including, but not limited to, ChatGPT, Claude, Cursor, Lovable, Bolt, v0, Replit, and other large language models
• Access a library of pre-built prompts and prompt templates
• Store, manage, and organize prompts within user accounts

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service without liability.

3.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security of your account credentials and not share your password with others
• Notify us immediately of any unauthorized access to or use of your account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. You agree to:

• Accept responsibility for all activities that occur under your account
• Keep your login credentials confidential and secure
• Not share your account with others or allow others to access your account
• Not create multiple accounts for the purpose of abusing service limits or promotions

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service:

4.1 Prohibited Content

• To generate prompts designed to create harmful, illegal, or unethical content
• To create prompts intended to harass, threaten, defame, or abuse any person or entity
• To generate prompts for content that promotes violence, discrimination, or hatred against any individual or group
• To create prompts designed to generate sexually explicit content involving minors
• To produce prompts for content that infringes upon the intellectual property rights of others
• To create prompts intended to deceive, defraud, or mislead others

4.2 Prohibited Activities

• Attempt to gain unauthorized access to the Service, other user accounts, or our systems
• Use any automated means (bots, scrapers, etc.) to access or use the Service without our express written permission
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to probe, scan, or test the vulnerability of the Service or breach security measures
• Use the Service to transmit viruses, malware, or other harmful code
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell, sublicense, or redistribute the Service without our express written permission

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including reporting to law enforcement authorities.

5.1 Our Intellectual Property

The Service, including its original content (excluding user content), features, functionality, software, and branding, is owned by One Shotr and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks, service marks, and logos may not be used in connection with any product or service without our prior written consent.

5.2 Your Content

You retain ownership of the prompts and content you input into the Service ("User Content"). By using our Service, you grant us a limited, non-exclusive, royalty-free license to:

• Process and transform your input to provide the Service
• Store your User Content as necessary to provide the Service
• Use anonymized and aggregated data to improve our Service and develop new features

5.3 Generated Output

The optimized prompts generated by our Service ("Generated Output") are provided to you for your use. You may use, modify, and distribute the Generated Output for any lawful purpose, subject to the following:

• We do not claim ownership of Generated Output, but we retain rights to the underlying algorithms and methods used to create it
• Generated Output may be similar or identical to output provided to other users; we do not guarantee exclusivity
• You are responsible for ensuring your use of Generated Output complies with applicable laws and third-party rights
• We make no representations about the intellectual property status of Generated Output

5.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use, modify, and incorporate such feedback without any obligation to compensate you.

6.1 Service Tiers

One Shotr offers both free and paid subscription tiers. Free tier users have access to limited features and usage. Paid subscriptions unlock additional features, higher usage limits, and premium support.

6.2 Billing and Payment

• Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan)
• You agree to provide accurate and complete billing information
• All payments are processed through our third-party payment processor and are subject to their terms of service
• Prices are subject to change with reasonable notice; we will notify you of any price changes before your next billing cycle

6.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until then.

6.4 Refunds

Subscription fees are generally non-refundable, except as required by law or as expressly stated in these Terms. If you believe you are entitled to a refund, please contact us at support@oneshotr.com. We may, at our sole discretion, provide refunds or credits in certain circumstances.

6.5 Failed Payments

If payment cannot be processed, we may suspend or downgrade your account until payment is received. We are not responsible for any loss of data or features resulting from account suspension due to non-payment.

You agree to indemnify, defend, and hold harmless One Shotr and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content or any content generated using your inputs
• Any claim that your use of the Service caused damage to a third party

10.1 Termination by You

You may terminate your account at any time by following the account deletion process in your account settings or by contacting us at support@oneshotr.com. Upon termination, your right to use the Service will cease immediately.

10.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Request by law enforcement or government agencies
• Discontinuation of the Service
• Non-payment of fees when due
• Unexpected technical or security issues

10.3 Effect of Termination

Upon termination: (a) your license to use the Service will immediately cease; (b) we may delete your account and User Content; and (c) you will not be entitled to any refund of fees paid, except as expressly provided in these Terms. The following sections will survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

11.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at support@oneshotr.com to attempt to resolve the dispute informally. We will work with you in good faith to resolve any issues within 60 days.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, you and One Shotr agree to resolve any disputes through binding arbitration rather than in court, except that either party may bring claims in small claims court if eligible. The arbitration will be conducted by a neutral arbitrator under established arbitration rules.

11.3 Class Action Waiver

YOU AND ONE SHOTR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms will be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice by:

• Posting the updated Terms on our website
• Sending an email notification to the address associated with your account
• Displaying a prominent notice within the Service

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the Service.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and One Shotr regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Force Majeure

We will not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet outages.
